Why Same-Day EIN Matters

You formed your LLC this morning. Your bank appointment is tomorrow. You need an EIN — the IRS Employer Identification Number — before you can open a business checking account, hire a contractor, or connect to Stripe. The good news: the IRS provides EINs same-day through an online application, as long as you apply during their operating hours and know how to navigate the rejection traps.

Step 1: Check You're Eligible for the Online Path

The IRS online EIN application is available Monday through Friday, 7 a.m. to 10 p.m. Eastern time. Weekends and federal holidays are closed — the portal literally goes offline.

You need a "Responsible Party" (typically the LLC's primary owner) with a valid SSN or ITIN. Foreign-owned LLCs without a responsible party in the US must file by fax (4-6 business days) or mail (4-6 weeks). You cannot get a same-day EIN without a US taxpayer ID for the responsible party.

The online application only allows you to complete one EIN per responsible party per day. If you already used your SSN for an EIN today, you'll have to wait until tomorrow or file by fax.

Step 2: Go to the Official IRS Page

Do not pay any third party that offers to "file your EIN" for you. The IRS charges $0 for an EIN, always. Anyone charging money to file the SS-4 is simply filling in the same free form on your behalf — which you can do yourself in 10 minutes.

Step 3: Select Entity Type

For a standard single-member LLC, select "Limited Liability Company (LLC)" then "Sole proprietor" on the next page. This is the most common path. The IRS will treat your LLC as a disregarded entity for tax purposes.

For a multi-member LLC, select "Limited Liability Company (LLC)" then indicate 2 or more members. The IRS will default-classify it as a partnership.

For an LLC that has already elected S-Corp treatment, select "Limited Liability Company (LLC)" then "Corporation (1120S)." The IRS will expect you to file Form 2553 separately after receiving the EIN.

Step 4: Reason for Applying

Nine options — pick the one that fits your actual situation:

"Started a new business" is correct for most new LLCs. "Banking purposes" is correct if your LLC existed but you only now need an EIN for a business bank account. "Hired employees" if you're specifically getting the EIN because you need to run payroll.

Pick the most specific option. "Banking purposes" is not the same as "started a new business." Getting this wrong can trigger additional questions the portal can't resolve.

Step 5: Responsible Party Details

The responsible party is the person with effective control over the LLC's funds and assets. For a single-member LLC, that's you. Enter your legal name as it appears on your Social Security card, your SSN (no dashes), your role (Owner, Manager, or Member), and your personal address.

Do not use your LLC's address here — use your personal home or mailing address. The IRS wants to verify the responsible party matches SSA records, and the SSA uses personal address data.

Step 6: LLC Details

Enter your LLC's legal name (exactly as filed with the Secretary of State, including "LLC" or "L.L.C."), your state of formation, and your principal business address. The principal address can be a PO box, home address, or registered agent address — the IRS isn't particular, but be consistent with what you put on state filings.

Start date: use the date your Articles of Organization were approved by the state, not when you started thinking about the business.

Closing month of accounting year: December unless you have a specific reason to choose otherwise. Almost all LLCs use a calendar year.

Step 7: Describe Your Business

"Principal activity" is a dropdown — pick the category that best fits. Most service businesses land in "Professional, Scientific, or Technical Services." E-commerce is "Retail." Real estate rentals are "Real Estate." The IRS uses this for statistical classification, not tax purposes.

"Describe your primary business purpose" is a short text field. Keep it simple: "Consulting services" or "Online retail" or "Real estate investment." Do not write essays — the IRS rejects applications with overly vague or suspicious-sounding purposes.

Step 8: Employees Question

"Do you expect to hire employees in the next 12 months?" Answer honestly. If yes, the IRS will ask for estimated wages so they can set up your employment tax account. If no, the answer is just "no" and you move on.

A single-member LLC that never plans to hire employees should answer "no." You can always add employee tax accounts later.

Step 9: Receive Your EIN

If all fields are filled correctly, the IRS will instantly generate your EIN and display it as a 9-digit number in format XX-XXXXXXX. You'll also get a link to download your EIN Assignment Letter (Form CP 575) as a PDF.

Save this letter. Every bank, payment processor, state tax agency, and insurance company will ask for it. Print a copy and store it with your LLC's Articles of Organization.

The 5 Most Common Rejection Reasons

1. **"Unable to process" message.** The portal occasionally crashes on specific entity types or rare combinations. If you get this message, wait an hour and try again with slightly different answers (like "Limited Liability Company" instead of "LLC" in the legal name field). If that fails, file by fax using Form SS-4.

2. **Responsible party SSN doesn't match SSA records.** If you legally changed your name recently (marriage, divorce), the SSA may not have updated yet. File by fax or wait for SSA to update.

3. **LLC not yet registered with the state.** The IRS verifies your LLC exists by checking Secretary of State records. If you apply for an EIN before your state approves your Articles of Organization, you'll be rejected. Wait for state approval first.

4. **Using a PO Box for responsible party address.** The responsible party must use a physical address for personal identification. Principal business address can be a PO Box; personal address cannot.

5. **Applying outside business hours.** The portal says "currently unavailable" after 10pm Eastern or on weekends. Come back during business hours.

You can't get a same-day EIN after the portal closes. Your options:

Wait until 7am Eastern the next business day and apply online. File Form SS-4 by fax (IRS fax line: 855-641-6935). Most fax filings are processed within 4 business days. Include a cover sheet requesting expedited service if you have a specific deadline. File by mail — 4 to 6 weeks. Only an option if you have no urgency.
